  45. 4.3 Travel Documents The Traveller must possess the necessary travel documents during the Trip, such as a passport, visas, vaccination certificates, etc.
  46. Given the great importance of this, the Traveller should verify with the official authorities whether the information is complete and up-to-date.
  47. The Traveller must check before booking the Trip whether there is sufficient time to obtain the necessary travel documents.
  48. If the Traveller is unable to make the Trip, or unable to make it in whole, due to the lack of the proper travel documents, the costs shall be borne by the Traveller.
  49. 4.4 Travel Documents If applicable, the travel documents (transport tickets, vouchers, etc.) will be sent to the Traveler no later than 7 days before departure, unless the invoice has not yet been paid in full.
  50. If the Traveller has not received the travel documents 5 days before departure, he/she must notify the Organizer immediately.
  51. 4.5 Information regarding insurance The Organizer requires the Traveler to take out travel insurance. Cancellation insurance is optional but highly recommended. Participation is not possible without travel insurance.
  52. In the event of an emergency, the Organizer is obliged to provide the Traveler with help and assistance. This may be seriously hampered if it is not possible to call upon the assistance of an emergency center included in the travel insurance.
  53. The Traveller must send or email the required travel insurance details to antoinettetimmer@sealence.nl no later than 2 weeks before departure.
  54. 4.6 Airline Ticket Arrangement The Traveler is expected to arrange their own airline ticket to the destination. The Organizer advises the Traveler to take out cancellation insurance.
  55. The Organizer also advises against purchasing a flight ticket until the Organizer has confirmed that the Trip will proceed.
  56. The Organizer bears no responsibility for the early purchase of the airline ticket or the failure to take out cancellation insurance.
  57. Article 5 – Information provided by the Traveller
  58. 5.1 Relevant information from the Traveler(s) For the booking, the booking Traveler provides all relevant information about the registered Travelers. In particular, information that may affect the health or safety of the Traveler or others.
  59. If the information provided is incorrect or incomplete, the Traveler may be excluded from participation. The Traveler shall then be liable for the cancellation costs in accordance with Article 9, paragraph 2. Other costs shall also be borne by the Traveler.
  60. 5.2 Reduced mobility, pregnant women and illness Travelers with reduced mobility and their companions, pregnant women, and Travelers with an illness that may affect the Trip must report this to the Organizer upon entering into the Agreement or, in any case, as soon as possible after the Traveler becomes aware of it, in connection with any potential consequences for the Trip and, in particular, air transport.
  61. These travelers must verify with the carrier themselves whether a medical certificate is required to travel.
  62. Chapter 4 – Before the Journey
  63. Article 6 – Payment
  64. 6.1 Down payment The down payment amounts to at least 20% of the total travel cost. The down payment must be received within 7 days of booking.
  65. 6.2 Remaining payment The remainder of the travel sum must be paid no later than 8 weeks before the start of the Trip.
  66. For bookings made within 6 weeks prior to the start of the trip, the full travel sum must be paid immediately after booking.
  67. In any case, full payment must be received before the start of the Trip.
  68. 6.3 Default and interest If the Traveler fails to pay within the agreed period, the Traveler shall be in default without the need for further notice of default, and statutory interest shall be due on the outstanding amount.
  69. 6.4 Collection Costs The Traveler must pay extrajudicial collection costs if payment has not been made within the final payment term set in a written reminder.
  70. The extrajudicial collection costs amount to: 15% of the amount claimed up to €2,500 (minimum €40), 10% on the subsequent €2,500, 5% on the subsequent €5,000, and 1% on the remainder.
  71. 6.5 Further consequences of non-payment As long as the Traveler has not paid, the Organizer may retain the travel documents.
  72. If payment remains outstanding even after a reminder, or if payment has not been made before the start of the Trip, the Organizer may exclude the Traveler from participation. The obligation to pay remains.
  73. Instead of excluding the Traveler from participation, the Organizer may cancel the Agreement and charge the Traveler the cancellation costs due for this as stipulated in Article 9, paragraph 2.
  74. Article 7 – Substitution
  75. 7.1 Conditions and notification A Traveller may transfer the Trip to another person. The other person must meet all conditions associated with the Trip and must be a replacement acceptable to the Organizer.
  76. Permission from the Organizer is required. If the relevant Trip is fully booked, it will be discussed whether participation can be transferred to someone from any waiting list.
  77. Transfer is only possible to the extent permitted by the terms and conditions of the relevant Travel Service Provider.
  78. The Traveler requests the Organizer to substitute the person no later than 2 weeks (14 days) before the Trip. This timeframe is fixed because the Travel Service Provider in Egypt requires the Travelers' exact passport details in a timely manner.
  79. If airline tickets are part of the Trip, transfer of the tickets is often not possible. Transfer of the Trip is then possible if new airline tickets are booked at the Traveler's expense.
  80. 7.2 Joint and several liability and additional costs The Traveller and the person taking over the Trip are jointly and severally liable for the payment of the travel sum and for the additional costs arising from the substitution, including administrative costs of at least € 65 and any modification costs arising from the booking process.
  81. Article 8 – Amendment at the request of the Traveller
  82. 8.1 Amendment The Traveler who booked the Trip may request the Organizer to amend the Agreement. The Organizer is not obliged to do so.
  83. The Organizer informs the Traveler of the new travel price. If the Traveler agrees to the costs of the change, the new travel price and change fees are due.
  84. If the new travel price is lower than the original travel price, the difference will be offset against the applicable modification fees.
  85. 8.2 Change of departure date Unless the Organizer indicates that a rebooking is involved, the change of the departure date constitutes the cancellation of the existing Agreement and the conclusion of a new Agreement.
  86. The cancellation policy of Article 9 applies to the cancelled Agreement.
  87. Article 9 – Cancellation by the Traveler
  88. 9.1 Cancellation The Traveler may cancel the booking before the start of the Trip. Cancellation must be made in writing.
  89. The date on which the cancellation is received by the Organizer shall be considered the time of cancellation. If received after 5:00 PM or outside of Working Days, the next Working Day shall be considered the date of receipt.
  90. Instead of cancellation, the Traveler also has the option to transfer the Trip to another person, provided that all conditions for this, as found in Article 7 (Substitution), are met.
  91. 9.2 Cancellation Fees When a Traveler cancels a Trip, the Traveler owes the following amounts:
  • Within 48 hours: full refund.
  • Up to 90 days before departure: the amount of the deposit.
  • From 90 days up to and including 64 days before departure: 50% of the travel sum.
  • From 63 days up to and including 43 days before departure: 75% of the travel sum.
  • From 42 days before departure: 100% of the travel sum.
  1. 9.3 Reduction in the number of Travelers If the number of Travelers is reduced within a single booking, the Organizer may charge the cancellation fees referred to in paragraph 2 of this article.
  2. 9.4 Cancellation costs upon cancellation after a rebooked Trip It may occur that the Traveler and the Organizer rebook the Trip to a later date.
  3. If the Traveler cancels the rebooked Trip, the cancellation costs shall amount to at least the amount that would be due if the trip had been cancelled on the date of rebooking.
  4. Example: 14 days before the start of the original Trip, the Trip is rebooked to 1 year later. 6 months before the start of the rebooked Trip, the Traveler cancels because he no longer wishes to travel. The cancellation costs would only amount to the deposit amount according to Article 9.2. The cancellation costs would amount to 100% of the total travel cost if the cancellation had taken place on the date of rebooking. In this case, 100% of the total travel cost applies as cancellation costs.
  5. See also Article 8.2.
  6. 9.5 Travel credits issued as a gesture of goodwill If a Trip is cancelled by the Traveler and a travel credit is granted as a gesture of goodwill, the following applies, unless other conditions are communicated by the Organizer:
  • the travel credit must be spent within one year after the travel credit has been awarded;
  • the new trip must have commenced within two years after the travel credit was awarded;
  • the travel credit is tied to the Traveler and is non-transferable;
  • the travel credit can only be used for the same trip at a later time;
  • if the Trip is more expensive at a later time, the price difference will be charged to the Traveler;
  • If the Traveler cancels the Trip booked with a travel credit granted as a gesture of goodwill, the travel credit shall be forfeited.
  1. 9.6 Voluntary Termination of Trip If a Traveller voluntarily decides to leave a Trip, for example due to medical reasons, he cannot claim a refund or reimbursement of additional costs incurred in connection with leaving the Trip.
  2. Article 10 – Price change
  3. 10.1 Price Change The Organizer may increase the travel price up to 20 days before the start of the Trip as a result of price changes in:
  • costs of fuel or other energy sources;
  • taxes or fees from third parties not directly involved in the execution of the Trip.
  1. The Organizer may include in the Agreement that it may increase the travel price up to 20 days before the start of the Trip based on changes in exchange rates. The method of price recalculation based on the exchange rate must be included in the Agreement.
  2. 10.2 Termination by Traveler If the price increase amounts to more than 10% of the total travel cost, the Traveler may terminate the Agreement and will receive a refund of the travel cost already paid, minus € 65 administration costs.
  3. 10.3 Price Reduction If the right to a price increase has been agreed, the Traveler has a corresponding right to a price reduction.
  4. If the price change leads to a price reduction, the revision will only take place if the associated costs are not disproportionate to the price reduction.
  5. Article 11 – Amendment by the Organizer
  6. 11.1 Changes The Organizer may unilaterally make minor changes to the Trip prior to the start of the Trip. The Traveler will be informed of this.
  7. The Organizer reserves the right to change the tour guide and send a guide other than the one agreed upon, should this be necessary, for example due to illness.
  8. 11.2 Major changes If necessary, the Organizer may make major changes to the main characteristics prior to the start of the Trip. This also includes offering an alternative Trip.
  9. The Traveler may accept the change or terminate the Agreement without payment of cancellation fees. Upon termination, the travel sum paid by the Traveler will be refunded.
  10. The Organizer may set a reasonable period for the Traveler within which the Traveler must clarify their choice. If the Agreement is not terminated within the set period, the change shall be deemed accepted and the right to termination shall lapse.
  11. Article 12 – Cancellation by the Organizer
  12. 12.1 Cancellation due to minimum numbers The Organizer may cancel the Agreement before the start of the Trip if the number of registrations is less than the minimum number stated in the Agreement and the Traveler is notified of this no later than 20 days before the start of the Trip.
  13. 12.2 Cancellation due to force majeure The Organizer may cancel the Agreement before the start of the Trip if the Organizer is unable to perform the Agreement as a result of unavoidable and extraordinary circumstances.
  14. 12.3 Refund of paid travel sum – no compensation In the above cases, the Organizer will refund amounts already received within 14 days and no compensation is due.
  15. Costs incurred by the Traveler for services falling outside the Agreement, such as vaccinations, visas, purchase of equipment, insurance and, if not included in the Trip, air travel, tickets, accommodation, etc., will not be reimbursed.
  16. 12.4 Cancellation due to the Traveler's actions If the Traveler fails to meet pre-established participation requirements or if incorrect or incomplete information about the Traveler has been provided, the Organizer may cancel the Agreement.
